LB807 was just passed this session and reduces the first offense somewhat and takes away the penalty of losing your permit if you are convicted of missing a sign. Change does not apply to any state or city owned premises.

I am not totally up to date on just how this change applies to your question, but research LB807's provisions

NFOA has a members only discussion on the topic here

I am looking at getting my CCW and I am attempting to educate myself as much as possible. The question I have is, does anybody know what the penalties for carrying in a business or area that is posted as a gun-free zone? I saw the following on the state patrol website regarding it:

028.03 The following offenses are classified as Class III Misdemeanors for the first
offense and as Class I Misdemeanors for the second or subsequent offense:
ƒ Permit holder carrying a concealed handgun into a prohibited place or
premises.
(See § 018 in the regulations or §69-2441 in the statutes.)

I simply ask because it is not always possible to avoid gun-free zones, and the decision to follow bad laws could get you killed.

Thanks in advance

Not sure I agree with the Doctor, but I am not a lawyer.I understood the law to ban firearms within the building...

TITLE 18 > PART I > CHAPTER 44 > § 930
§ 930. Possession of firearms and dangerous weapons in Federal facilities

(a) Except as provided in subsection (d), whoever knowingly possesses or causes to be present a firearm or other dangerous weapon in a Federal facility (other than a Federal court facility), or attempts to do so, shall be fined under this title or imprisoned not more than 1 year, or both.

(1) The term “Federal facility” means a building or part thereof owned or leased by the Federal Government, where Federal employees are regularly present for the purpose of performing their official duties.
(2) The term “dangerous weapon” means a weapon, device, instrument, material, or substance, animate or inanimate, that is used for, or is readily capable of, causing death or serious bodily injury, except that such term does not include a pocket knife with a blade of less than 21/2 inches in length.

(h) Notice of the provisions of subsections (a) and (b) shall be posted conspicuously at each public entrance to each Federal facility, and notice of subsection (e) shall be posted conspicuously at each public entrance to each Federal court facility, and no person shall be convicted of an offense under subsection (a) or (e) with respect to a Federal facility if such notice is not so posted at such facility, unless such person had actual notice of subsection (a) or (e), as the case may be.

"except as prohibited by Federal Law" There are signs at the entrance to the parking lot at the Grand Island VA that say "no firearms". My Dr. friend there says they will fine you $500 if they see a gun in your vehicle. What about "long guns"? I thought Ne. law would prevail, but he says not.

Jerry, you can carry concealed, in the vehicle only,(with a valid permit) in any parking lot accessible to the public as long as the handgun is locked up as prescribed by law before exiting the vehicle. One caveat is that this law will not protect you from your employers policies

Here is the regulation from the Nebraska State Patrol website http://statepatrol.nebraska.gov/forms/ccw/CCWRegs.pdf

018.06 Except as prohibited by federal law, a permit holder may carry a concealed handgun in a vehicle or on his or her person while riding in or on a vehicle into or onto any parking area which is open to the public and used by any of the places or premises listed in Section 018.01 above if the handgun is not removed from the vehicle and the handgun is properly secured in the vehicle before the permit holder exits the vehicle. To be properly secured in the vehicle, the handgun must be locked inside the glove box, trunk or other compartment of the vehicle, in a storage box attached to the vehicle, or in a securely attached hardened compartment if the vehicle is a motorcycle
