I am doing some research on behalf of myself and other Nebraska firearm owners, especially those in the city of Lincoln and elsewhere in Lancaster County. I am compiling a list of approved law enforcement officials who can provide a signature to complete the "Chief Law Enforcement Official" (CLEO) certification requirement necessary to submit a National Firearms Act (NFA) application to make or register an item regulated by the NFA. These applications are required under the 1934 federal law and related regulations for the making of NFA items by people who are not licensed manufacturers, as well as for the transfer of such items to or from non-licensees. The majority of applications to make or transfer NFA items are related to transactions involving firearms silencers, hearing safety devices which diminish the audible report of a firearm and make it more safe for the user, for observers, and for others who may be within earshot.

If you are not familiar with the NFA process you might wonder what your certification is meant to certify. The relevant federal regulation provides that these applications must include a certification by a CLEO that the official has “no information indicating that the transferee will use the firearm or device described on this application for other than lawful purposes," and "no information that the receipt or possession of the firearm or device... would place the transferee in violation of State or local law."

Please understand that these transactions requiring a CLEO certification are subject to an extensive and rigorous application process which includes fingerprint-based background checks, submission of photographs of the applicant, and other information about both the applicant and the item that is the subject of the application.

Below are three choices from which to select your response and a line for your signature. Can you please select the box indicating your position on whether or not you are willing to provide this certification when appropriate per the standard set out in the language described above? I have also included a self-addressed, stamped return envelope for your convenience.

The only thing I might see in this revision is changing silencers to suppressors, just following the change that the movement has been trying to do to the language.  Obviously they do not silence the firearm they only suppress or reduce the sound.

The legal terms of art used both in the National Firearms Act and in the federal regulations are "firearm silencer" and "firearm muffler."

The word "suppressor" introduces an ambiguity, since firearms often employ flash suppressors. I think the word "silencer" is more correct from a legal point of view, and it is less likely to lead to confusion for the reader.

Thank you very much Citizen! You took my ramble of a letter and turned it into very nicely wrote letter.

A question for you.... Do you know what judges can sign? Or do you know if I can send the list to the ATF for there verification?
