Nebraska Supreme Court backs sender of angry e-mails

Angry, profanity-laced e-mails sent to a professor by a college student are protected by the First Amendment, the Nebraska Supreme Court said in a ruling issued Friday.

Darren Drahota was convicted of disturbing the peace and fined $250 for e-mails he sent in 2006 to former University of Nebraska-Lincoln political science professor Bill Avery. At the time, Avery was running for a seat in the Nebraska Legislature, which he won, and Drahota was a UNL student. A California law professor who took Drahota's case to the state Supreme Court, Eugene Volokh, had argued that although Drahota's messages irritated Avery, their contents alone didn't merit a criminal accusation.

Don't agree with the student's behavior, but the "Elitists" are not entitled to special protections by the law.
