The article states that MERCHANTS sold pistols to people claiming they couldn't pass a background check. Appears they were actually private citizens selling them- hence no need for a NICS check. Not that I expect Bloomberg to know or care about that distinction but the Arizona AG certainly should. If a FFL actually sold under those circumstances it is already illegal.
