My thoughts exactly. After all, the anti's always point to the average citizen's lack of training and how that would lead to this very thing happening. We already know Joe Citizen wouldn't get a pass.

My S&W snubby has some nasty rash on it for this very reason. Ham Handed Me fumbled it one day, and rather than attempting to catch it I just let it drop.
And Shawn is correct, it very well could have just snagged a piece of gear. I was being a little assumptive saying he tried to catch it. I wonder how it could have fallen out of his holster? That makes me think it was probably not his duty weapon, since LEO holsters usually have excellent retention.
