Handguns and crossing state lines...
« on: July 30, 2012, 04:13:10 PM »
i have a coworker who lived in Iowa, but he has moved to NE (of course) and he has a handgun in Iowa at his parent's place.  the handgun was given to him by his father for Christmas.   he is going to get his purchase permit this week and he already has a NE driver's license.  Can he legally possess his handgun in NE without going through an FFL?  the handgun is registered in Iowa, so would he have to do anything with that?

ETA: it isn't registered, its transferred... confusion of terms.

The only issue would be if he is inOmaha he needs to take it in and register it.  Otherwise just transport unloaded and cased away from the driver (trunk or back of vehicle).

One more thing to consider while in Iowa. Unload the gun for transportation. If it is an automatic, unload the magazines, too. From what I have read, it is illegal to have the magazine loaded even if it is not inserted into the gun. It's a game law thing, nothing to do with carrying. (I have often wondered what they would say if one had a loaded magazine but no gun.)

If he owned it before he moved, there is no problem with moving it to his new residence in Nebraska. There is no need to have the purchase certificate since there is no transfer taking place.
