I'm not sure of the configuration of the M&P used in Colorado, but it's entirely possible for an AR not to qualify as an "assault weapon" under the definition of the '94 ban.  S&W's "Performance Center" and "Compliant" lines would all be exempt from the old ban.

What I was trying to point out that according to John Lott the total number is one (Gabby Gifords), with the research he has done I would use his number and say that it is per his research.

Andy, if you live on base you can certainly have guns in your home. and you can transport them on base. They have to be unloaded and stored with no "quick access" by any occupant. It may be different for Army bases but that's how it works on Air Force bases.
