Box Cutter a Concealed Weapon
« on: April 17, 2013, 10:57:04 AM »
This from an article in the York News Times regarding the court hearing a man brought up on drug charges.

Quote
And as far as carrying a concealed weapon, that was a box cutter I had at work.

Entire article  here

Recently, another article reported a man carrying a pocketknife in his pocket during a robbery was charged with carrying a concealed weapon.

I'm not defending these guys for the crimes they committed.   Just wondering how box cutters and pocketknives become concealed weapons... that interpretation makes a lot of Nebraskans guilty of carrying a concealed weapon and even if one had a CC permit,  that doesn't cover knives.

Thoughts?

5: Knife means any dagger, dirk, knife, or stiletto with a blade over three and one-half inches in length or any other dangerous instrument capable of inflicting cutting, stabbing, or tearing wounds;

In Nebraska (this is state law, some local laws stupidly may vary) the court would have a difficult time attempting to prove that anything with a smaller blade (like a box cutter) would be a "concealed weapon" unless the person had demonstrated some sort of direct intent to use it as a weapon.

[sigh]

I'm getting older, slower, and I'm frail and easily bruised.  I'm no threat to ANYONE.

At all.

Nope.

We all face that realization eventually.  Perhaps you should consider buying a gun...  :P

What, carry a DANGEROUS WEAPON?!  Someone might get hurt!

Kellermann says it'll probably be someone in my house!  Wintemute says it'll be someone that I love!  And police chiefs in large cities in Nebraska say that I wouldn't be able to use it well enough for self-defense purposes!

No, no, that just seems a bad idea.*

Jt besides that some thing we shouldn't let you wander around on your own.  ;D

We in Nebraska are behind the times AGAIN!

Tennessee is the seventh state to pass Knife Law Preemption since Knife Rights passed the first-in-the-nation Knife Law Preemption bill in Arizona in 2010, and the third state this year, following Kansas and Alaska.
