Title: Penalties for Violation of NAC Ch 21 Section 18 Concealed Carry Provisions
Post by: SemperFiGuy on January 25, 2017, 01:43:12 PM
Other postings on this Forum are discussing the what-ifs of carrying in prohibited places.
This item is of sufficient importance to deserve its own posting.
So here we go:

Penalties for violation of certain NAC Ch. 21 Section 18 provisions:

--------------------------
028.03   Penalties
The following offenses are classified as Class III Misdemeanors for the first offense and Class I Misdemeanors for the second or subsequent offense:

   >Permit holder carrying a concealed handgun into a prohibited place or premises

---------------------------
Nebraska Misdemeanor penalties are not trivial:

Class I misdemeanor
Maximum — 1 year or less imprisonment,         or $1000 fine, or both
Minimum —  none

Class II misdemeanor

Maximum — 6 months imprisonment, or           $1000 fine, or both
Minimum — none

Class III misdemeanor
Maximum — 3 months imprisonment, or          $500 fine, or both.
Minimum — none

=====================================

Any violators would then have a firearms violation on their records.    Goodbye to personal concealed carry for the next ten years.

FYI,

Agreed, this needs to be brought up often especially with new people checking these forums out.

For further clarification, Penalties Section 0.28.05 of Title 272, Nebraska Administrative Code, Chapter 21 Nebraska State Patrol says:

"Violators are also subject to revocation of the concealed handgun permit, except that a permit will not be revoked based on the permit holder's first conviction for carrying concealed in a prohibited location (in violation of Section 69-2441) that did not occur on property owned by the State of Nebraska or any political subdivision of the State of Nebraska, but a permit may be revoked for any second or subsequent such offense".

Still, a very serious penalty for carrying concealed in a prohibited location, even for a first offense.
