Title: Transporting NFA across state lines
Post by: wallace11bravo on November 08, 2012, 04:44:28 PM
Just wanted to confirm. My impression is:

ATF form 5320.20 is required for: (http://www.atf.gov/forms/download/atf-f-5320-20.pdf (http://www.atf.gov/forms/download/atf-f-5320-20.pdf))

SBR/SBS
AOW
Full Auto

Not for cans.

Forms only need to be completed for destination, not all states you are travelling through.

Transport through non-friendly state:

Under NFOPA, short stops necessary to travel, such as gas, rest, etc are permitted.

It would be nice to have a comprehensive guide to NFA purchase and other FAQs cough:dave:cough  :)

My specific questions:

1. Planning my trip to Missouri, only taking a can, so I do not need to do anything, correct?

2. I am good to travel through Iowa with the item, correct?

1. You're correct.  No form is required for cans, though it of course must be legal where you're headed.

2. You're okay traveling through IA if you keep the can in a locked case because you're covered under the Safe Passage Provision in the 1986 Firearm Owner's Protection Act.  Plus a locked case is excluded from a Terry frisk and requires a warrant to open.  Of course, use your head and don't invite trouble: drive responsibly and at reasonable speeds.

Thanks. Just wanted to make sure I am not misinformed in my first journey out of state with an NFA item.

I am planning on locking it in a case regardless, and you are more or less correct on the Terry Stop, but does the NFOPA require the item to be in a locked case?

...but does the NFOPA require the item to be in a locked case?

IIRC, yes the NFOPA does require unloaded boomstick in a locked case, but surfing on my phone right now and not at my computer computer to search through the act with a [ctrl]+F.

Does anyone have a good list of NFA laws by state?

Here is such a list that was prepared by a Texas attorney, but I have not checked it for accuracy: http://www.texasnfatrust.com/NFA%20Laws%20by%20State.htm (http://www.texasnfatrust.com/NFA%20Laws%20by%20State.htm)

Read the form, if it is not listed it is not needed. Neither Silencers nor AOWs need the notification for a temporary transport.
