Title: Omaha, NE and Machinegun Parts kits.
Post by: David Hineline on January 11, 2010, 01:30:23 AM
Ok I got a new Centerfire Systems catalog in the mail.  They have M16A1 parts kits with no receiver.  They have text in the add listing places they can not sell the kit to.

One of the places listed was Omaha, NE

is there some obscure law I do not know about.

This is all I can find in the Municiple code:

Sec. 20-203.  Possession of machine guns.
(a)   It shall be unlawful for any person to possess any machine gun.
(b)   It shall be an affirmative defense under this section that the accused is a member of one or more of the following classes:
(1)   Authorized law enforcement officers in the performance of their official duties;
(2)   The armed forces of the United States, including ROTC units and the National Guard in the performance of their duties;
(3)   Any person or persons or corporation licensed by the federal government as a dealer in machine guns under the provisions of the National Firearms Act; or
(4)   Any person lawfully purchasing and possessing a machine gun under applicable federal law.
(Code 1980, ? 20-203; Ord. No. 33757, ? 8, 12-19-95)

It looks to me like there should be no problem just so the purchaser gets the proper Federal permit.  But that could be the problem, you don't need the Fed license to purchase the parts, but Omaha considers the parts to be a machine gun.

I heard that the kits they have include some of the original full-auto fire control parts.

With that said, I'm not sure why they won't ship to Omaha.

Dave, you should contact them and see what their reason is.

thesportsmansguide.com also has them for sale.  i emailed them about the kit and they said it does not come with a lower reciever or disconnector so its not a gun and it can be shipped to your house.  i decided against it.  i had posted something in one of these forums, but can't remember which one.  there is also something ar15.com under the armory and class 3 section awhile back about it.
