OMAHA, Neb. -- The customer who killed a would-be robber inside an Omaha Walgreens will not be charged, according to the city prosecutor.
Marty Conboy made his decision Tuesday just after 2 p.m., saying James McCullough's weapon was not completely concealed during the incident.
McCullough opened fire on 18-year-old Marquail Thomas after police said Thomas barged into the store with a sawed-off shotgun and demanded money.
McCullough had a registered weapon but no permit to carry it concealed. tp://www.ketv.com/news/23450576/detail.html

Does anyone know how he was carrying it. It could be in the waistband but still be carried openly as long as a shirt doesn't cover it entirely.

James has declined to say just how he carries his handgun, and I agree that there is no need for anyone to have that information. It is a moot point anyway

Agreed. So how is our effort to repeal Omaha's concealable firearm registration ordinance going? I sent out emails to all city council members. I got two swift replies (Once positive, one negative). But have not heard from the other members.

My guess...Omaha will comply with the state rules concerning CHP holders starting July14, 2010, but they will not publicly concede anything.
I don't see them giving up any other powers without a fight

Dan, Are you going to forward this newsbreak to the NRA publication? It would be good coming from the administrator of the NFOA and just maybe they can contribuite to the on going process here in the State.

Channel 3 has a poll on their front page (http://www.action3news.com/) asking if people agree with the decision to not prosecute Mr. McCullough for carrying without a CHP. So far, the results are 97% to the good.
