Title: Westroads Mall, Omaha
Post by: Greybeard on February 20, 2011, 04:36:59 PM
I just returned from a shopping trip to the Westroads mall. There are no signs on the exterior food court doors, Von Maur doors nor on the Younkers doors. Could it be that someone has gotten smarter?

Maybe Greybeard.  Last September, when I did the research project (http://omaha.peoplespresscollective.org/2010/10/02/nebraska-concealed-carry-law-needs-signage-revision/) on the variety of CCW signs throughout the state, there weren't signs on the entrances to Dick's or Von Maur, but I did find this sign (see bottom right bullet) on a side wall at one of the common entrances, think it was the northwest one.  Take a look for this one next time you're there:

I see toward the bottom that it says this.

Guests who do not act responsibly may be asked to leave. If they refuse to leave the property, they may be arrested and prosecuted for criminal trespass.

Does this mean it is okay to carry a gun in the mall until you are asked to leave? That is the way I read it.

Thanks Wesley. I will look for that sign. Didn't look at any sidewalls while I was there.

My question is, under our current law, is this valid?

I would say yes with some uncertainty but yes to err on the side of caution.  I'm not so confident because I don't think this is posted conspicuously because its a small bullet point to the side of the entrance like Oak View mall.  So my issue is how would this be conspicuously posted?  I really hope the new Christensen bill passes so that this type of nonsense can be taken care of.

It does not pass reasonableness test.  If it were posted on the doer maybe, but it is not posted on the door.  Its off to the side wall in the lobby.

It does not pass reasonableness test.

What's this reasonableness test of which you speak? ;) It may not seem reasonable to the general citizenry, but the current statutes don't define "conspicuous".  That means in an anti-gun municipality, you could find yourself on the receiving end of an overzealous prosecutor.

Christensen's LB88 (http://www.nebraskafirepower.com/forum/index.php?topic=3041.0) is currently in the Judiciary Committee.  I'd suggest to anyone who hasn't called or emailed each member of the committee, that you do so and encourage the Senators to support the bill before it comes up for a vote, or it won't even make it out of committee.  See below:
