Title: Might be in a pickle

Got a voicemail from Fedex today saying my TC Venture I sent in for the recall is due to be delivered in Lincoln tomorrow. So I figured I would save myself some trouble with the apartment complex office staff and have it kept for pickup at one of the Fedex stores. As soon as I submitted the form to keep for pickup I realized someone has to be 21 to sign for it. Sadly I fall about 4 months shy of that wonderful age. I am probably going to head over there in the next few minutes and see how big of a problem this will be. If I have to get someone who is 21 to sign can I get any volunteers to help me out if need be? Going to be held at the Fedex Building at 3600 N 20th st sometime tomorrow or the next day.

Well just got back from Fedex and after about 15 minutes of them all asking each other what to do some lady said the person has to live at my address when they sign. This may be a problem since my roommate who is 21 has been in the process of having his name changed and I don't believe his drivers license matches what our lease says. (the lease is to prove he lives here) Frustrating as heck, why can't Smith & Wesson use UPS, they are way better at being helpful in situations. Sorry for my venting... Haven't had my baby in my arms in almost a week and just want her back  :(

Why would you need to be 21 if the package is addressed to you? That's an interesting restriction, for sure.

Pretty sure it has to be 21 since it is a gun being shipped directly to someone, helps make sure the driver doesn't leave it on a porch somewhere. If I would have known all this I wouldn't have sent it in for the recall

As far as I know, you only have to be 21 to buy a gun. I don't know about signing for one, but I wouldn't doubt that you can't be a minor to do it.

From Fed ex. My question is "What is legal age"?


Firearms

      A.  FedEx Express will transport and deliver firearms as defined by the United States Gun Control Act of 1968, between areas served in the U.S., but only between:

         1.   Licensed importers; licensed manufacturers; licensed dealers; licensed collectors; law enforcement agencies of the U.S. or any department or agency thereof; and law enforcement agencies of any state or any department, agency or political subdivisions thereof; or

          2.  Where not prohibited by local, state and federal law, from individuals to licensed importers, licensed manufacturers or licensed dealers (and return of same).

     B.   If your shipment contains firearms, select the Direct Signature Required or Adult Signature Required Delivery Signature Option, depending on the requirements of your shipment. See the Delivery Signature Options section for details. Firearms shipments are not eligible for signature release or indirect delivery.

    C.   Firearms must be shipped via FedEx Priority Overnight service. FedEx Express cannot ship or deliver firearms C.O.D. Firearms shipments cannot be placed in a FedEx Express Drop Box.

      D.  Upon presenting the package for shipment, the person tendering the shipment to FedEx Express is required to notify FedEx Express that the package contains a firearm. The outside of the package must not be marked, labeled or otherwise identify that the package contains a firearm.

      E.  The shipper and recipient must be of legal age as identified by applicable law.

       F.   The shipper and recipient are required to comply with all applicable government regulations and laws, including those pertaining to labeling. The Bureau of Alcohol, Tobacco, Firearms and Explosives can provide assistance.

      G.  FedEx Express will transport ammunition when packed and labeled in compliance with local, state and federal law, and the Dangerous Goods section of this Service Guide. Ammunition is an explosive and must be shipped separately as dangerous goods. You agree not to ship loaded firearms or firearms with ammunition in the same package.

Legal age for purchase of a long gun is 18, is it not?

I believe it has to do with the senders request for "adult signature required".   Seems like UPS and FedEx determine that to be 21.

That may very well be, but they say legal age in their rules, does that mean that they can supersede the written law?

Nebraska Revised Statute 43-2101
Revised Statutes » Chapter 43 » 43-2101
 
43-2101. Persons under nineteen years of age declared minors; marriage, effect; person eighteen years of age or older; rights and responsibility.

All persons under nineteen years of age are declared to be minors, but in case any person marries under the age of nineteen years, his or her minority ends. Upon becoming the age of majority, a person is considered an adult and acquires all rights and responsibilities granted or imposed by statute or common law, except that a person eighteen years of age or older and who is not a ward of the state may enter into a binding contract or lease of whatever kind or nature and shall be legally responsible therefor.

Dan has your answer.  As long as you are 19 or older, you are in possesion of the proper legal capacity to sign for and recieve packages requiring an "adult siganture".

We just covered this in Law this morning as a matter of fact.

It's a rifle so I only need to be 18 to buy it anyways.

Just went back today with my roommate who is 21. Wouldn't take his military I.D. as proof of age which makes no sense. But they accepted his drivers license and didn't ask for proof that he lives with me. I guess it all depends on who you get when you go in. Got the gun back without much problem now except the bolt doesn't feel quite as smooth as it used too...
