Well here goes a rant about Dick's. Went in to get an 870 express for their black Friday deal. The guys behind the counter couldn't tell you a thing about guns from the looks of it. The kids working didn't even know how to break down guns to put them in boxes and one even tried forcing a Rossi single shot apart while it was still cocked. They wouldn't accept concealed carry permits for long guns to get out of the background check that they couldn't even start until the NICS office opened. And on top of that they only had 1 870 12ga 26" in stock and it was a damaged display gun (the rib was breaking off). So in conclusion my first (and last) black friday experience was awful, and to top it all off the people working didn't even know the laws. The lead guy even called his boss to check if they accepted concealed carry permits since so many guys were arguing with them, and his BOSS told him they aren't valid for purchasing a gun... Stayed up and spent an hour and a half in a store without getting a thing.

Same exact crap at Dunhams in Hastings. I now have two places on my list of not spending any more of my money.

I couldnt agree more with you. I went to these guys today at 3am in the morning because I wanted to get the Mossberg Maverick 88 and the S&W M&P15-22 Rifle. They had an advertisement for the Mossberg in the paper that it was selling for $160 on black friday. I got into the store at 3am and the guy there told me they haven't had those in stock for weeks....Okay no big deal so I wanted to get the .22 Rifle still and they had that in stock.

This is my first time buying a gun, heres what happens next:

1. Fill out paperwork for background check, I moved back to Nebraska for North Carolina for college (and live with my grandparents) awhile ago but I never got my license changed due to part laziness and the hassle of dealing with the DMV. The guy at the counter says to fill in where I live now as the current residence (in Nebraska) and he put down my North Carolina license for the license number. He said the place that does the background checks doesn't open until 6am and that my application would probably be delayed since my current address and the license did not match up and that I would get a call when it was ready. It is 3:40am at this point so I said whatever and went home to sleep.

2. Next thing I get a call at 7:30am in the morning (4 hours after I left) saying that the background check was approved and everything was fine. So I go back to sleep, wake up at 10:30am and go back to Dick's. Once I get there a different guy was working and he got my gun from the back and pulled out the rest of the paperwork and then asked for my license. I gave him my license and he asked why it was North Carolina, I explained this again and he said he would have to ask his boss. His boss comes back and says I have to have some government tax or official document showing that my address is indeed the Nebraska address I listed and I would have to come back with this later. At this point I was like WTF...I fill out and a background check with my Nebraska address and my North Carolina ID and it was approved with no problems, now I have to go home AGAIN and get more documents.

3. I go home and I have plent of mail, bank statements, pay check stubs, etc with my current address on it but they said none of this will prove that I live at that address (KEEP IN MIND I USED ALL OF THIS TO REGISTER TO VOTE WITH NO PROBLEM)...so this is what I found that I have that could probably work to their standards: Selective Service Registration Card (Draft) with my current Nebraska address and some college classes (UNO/UNL) tax receipt for when I file my income taxes.

4. I take all of this back and at this point it is probably around 1pm. I bring all of this stuff to the guy at the counter and he says this will probably work but he will have to check with his boss again. His boss said he didn't even know what selective service was and from the sounds of it acted like he had never registered for it (it is illegal not to register for the draft after you turn 18) the guy at the counter explained what it was and he said he would have to check with corporate to make sure this is okay. So I wait another 30 minutes and he finally comes back and tells me that the guy isn't picking up and they would call me later today to tell me what he says. Apparently Dick's has a corporate policy that they won't sell weapons to any out of state persons!

5. Now I go home after going to Dick's for the 3RD TIME and I wait, it comes around 5:00pm and I haven't received any phone calls, seriously how hard does it have to be to CHECK WITH THE BOSS. I call up the store to see what is going on and the guy in "the lodge" says he would call his boss and get back to me right away. Well, now its almost 8PM and I haven't gotten any calls telling me what is going on.

I WILL NEVER GO BACK TO DICK'S AGAIN.

Does anyone know if this "not selling guns to out of state persons" is a law and if not, does any one know of anywhere I can go that doesn't have this ridiculous policy? I tried to research all the Nebraska gun laws and it is telling me that we don't have any laws other than the Federal laws for rifles. I went over the Scheel's to glance at what they had and they had at least 10x the selection and they had the gun I wanted for the same price, but I don't want to start the process there if I am going to run into the same issue...

Brad,

I went into the same store and I was looking at ar-15's. The first question the guy asked me, "well are you looking for a fully-auto M4 because we have some styles in the back like that". I proceeded to just leave.  If you are going to sell guns, please train the employees basic knowledge and let them know Dicks is not a Class III weapons dealer.... I almost started laughing in his face...... Just my .02 cents worth!

If you considered out of state the firearm has to be transferred through a ffl in that state. You might want to get a Ne.  id and purchase permit to help make the process easier.

I am going to work on getting my NE license soon, I accidentally threw away my social security card awhile ago so I am in the process of getting a replacement so I can work on the license.

I am considered an instate resident, I graduated from a Nebraska High School and have recieved a scholarship for a state college (which you can only get if you are a state resident). Regardless though, this is what I read from the ATF Federal Firearms License quick reference guide:

Permitted Sales to Non-Residents of Your State
You may sell a firearm to a person who does not reside
in your State by shipping the firearm to a licensed
dealer in the buyer’s State of residence and having the
buyer take possession of the firearm from that licensee.
The licensed dealer in the buyer’s State of residence is
responsible for the Form 4473 and NICS background
check. Your A&D records should reflect the transfer to
the out-of-State FFL and not to the end purchaser.

You may make an over-the-counter sale of a rifle or
shotgun to a non-resident if the transaction complies with
all the laws of your State and the laws of the buyer’s
State.


So I think what you are saying is only true for handguns right? Sorry to get off topic here

Long guns can be purchased out of state and not be transferred to an FFL. Handguns have to be shipped to an FFL in your state of residence.

Okay that is what I thought. I am kind of in a weird situation since I am a state resident with an out of state license (since I have waited so long to get my Nebraska license) so when I filled out my 4473 I listed my Nebraska address and the guy at the counter filled in my North Carolina License number. But now they want me to prove I am indeed a resident, but I can only use documents that they specify (more strict than the type of documents I had to provide for voter registration in NE). So this is a store policy not to sell to out of state residents.

As far as the Dick's at Oakview goes I won't be shipping there again. They did not know the law and could not tell me when I asked and could only tell me that it was a store policy not to sell to out of state residents and that he "thought" it was a Nebraska law too.

If they call me tomorrow and decide that I have provided enough proof of residency (I provided them with SSS (Draft) Registration Card and State Tax Receipt) I will go ahead and purchase the gun through them just so I don't have to jump through any more hoops for now.

It is absolutely ridiculous though that they made me run back and forth so many times and then kept telling me they would call and never did (even after I called them).

I call bull**** on this. Show me the law. You cannot go to Iowa buy a long gun and take it home to another state yourself. You can buy any firearm out of state but they all have to be transferred to a ffl in your state.

herewith permits its residents, not otherwise precluded
by any applicable laws, to purchase, sell,

It's not a law, its "company policy" as it was described to me.  I went there to pick up an 870 I had my NE DL, and MIL ID card I am a state resident, but I live (stationed) in Washington. When I filled out the form the gun counter told me a WA address wouldn't do, so I went to put my NE address, and explained I was in the military, and just picking this up as a gift for a family member. He told me I couldn't do that.  I then handed my brother the $250 (or however much it was) and he filled out the form and he bought his own Christmas gift right there in front of the employees. Thanks Dicks.

Same place differnt time, my brother in law was looking at guns, and told the guy working the counter he was wrong on some details that he was spreading to other customers.  The store manager over heard this and offered my brother in law a job on the spot which he promptly turned down.

They don't know the law OR company policy there. Bunch a schmucks if ya ask me.

I concur with bradnoll on out of state long gun purchases....   

I personally have purchased long guns from Bass Pro, a pawn shop in Council Bluffs and a gun shop in Missouri Valley with only a Nebraska DL, a permit to purchase and most recently a CHL.  As soon at the paperwork was filled out (no calls were made) I either walked out with my purchase or was escorted to the front door with purchase in the hand of a clerk.

Handguns are a whole different can of worms.  A purchase at Bass Pro had to have a FFL and shipping information to send the item to them where I paid a small transfer fee.

Wrong. You can buy a long gun across state lines in person, as long as the long gun you are buying complies with all your local laws.

Yep, you got it. You can transport your own long gun back to your home state, but when you introduce a shipping service, the rules change.

I did buy a Ljutic trap shotgun at the Grand American in Vandalia Ohio circa 1998, and I was a Nebraska resident,  but I am pretty sure that there was a special waiver from BATFE for the dealers at the ATA national tournament

I have purchased several long guns in Iowa and live in NE. I have not had to send them to an FFL in NE.

Is this a Nebraska law? The federal law says nothing about just contiguous.

A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

[18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30]

Got a brother that works the gun counter at Bass Pro in Iowa. He sells long guns all day to NE residents.  Handguns are another story.

Not sure of other walmarts.  North platte walmart has a map of state residents they can sell to.  Its most of the states except the ones with anti gun laws.

Back to Dicks…

The one in Shadow Lake has at least one salesman at the gun counter that has a clue.  I was in there looking at guns while the wife was off shopping at another store and the salesman and I had a pretty nice conversation.  He was more into the Cowboy Action area than I am, and didn’t seem to have much of a clue about the current state of CCW law in Nebraska, but he knew guns.  He also knew that a CHP was allowed in place of the NE Purchase Permit. 

All in all I have had mostly pretty good experiences with Dicks.  They are not Cabela’s by any means, but the one salesman seemed pretty much on-the-ball.
