Title: Firearms Freedom Act
Post by: Mudinyeri on January 03, 2013, 11:07:12 AM
As of December 27, 2012, Nebraska was one of a handful of states that has not either passed or introduced a Firearms Freedom Act.  [See map of states here: http://firearmsfreedomact.com/state-by-state/ (http://firearmsfreedomact.com/state-by-state/)]

If you are not familiar with the concept of a Firearms Freedom Act, The Firearms Freedom Act (FFA) is a state law which declares that any firearms made and retained in-state are beyond the authority of Congress under its constitutional power to regulate commerce among the states.

I know this has been discussed in the past.  Perhaps it is time to bring it up again and find a senator who will sponsor such a bill.

So, that would mean that if any  Federal semi-auto ban passes, and the FFA were in place, in theory, someone in Nebraska could build and sell semi autos that would otherwise be banned???

What about BATF regulations, federal excise tax, background checks, NFA items, etc.......???????

After some more thinking, it would most likely be challenged by the Fed Govt (if it hasn't been started already) and taken to the Supreme Court- the sooner the better. If some conservative judges retire, Obama has some liberals ready to go...

That is one of the issues we are working on, we have been in contact with several Senators as well as Gary Marbut the original drafter of this legislation.

I'm all for this. It'd only work if we make enforcement of federal laws on NE only guns a crime.

Sounds good in theory but I don't see how it trumps federal law?
Kind of like states allowing recreational marijuana use.
Are you saying I could build a full auto suppressed AR without repercussions, So long as it didn't leave the state? 8)

Edit: after reading your second link, I have a better understanding of the point on the legislation. To challenge the way the federal government operates under the tenth amendment. All we can do is hope the supreme court rules in our favor.
