The Arizona law that challenges federal authority over guns made entirely within the state saw a victory at the 9th Circuit Court of Appeals. Gary Marbut of Montana, who crafted the original law, was just granted “standing” by the 9th Circuit, overturning a lower court that denied him this legal power to pursue his case. This means he is on track to approach the U.S. Supreme Court in an attempt to stop the federal government’s out-of-control use of the Commerce Clause to regulate firearms within our state boundaries. It’s a narrow result a long way from done that left the Commerce Clause untouched, but it’s a step in the right direction. We could build guns in Arizona that the feds cannot control if we win the case. I’ll have more on it soon.
