KETV Gun Free Zone Poll...
« on: December 01, 2015, 07:39:56 PM »
http://www.ketv.com/

Poll low on the left side:

NOW POLL:  "Should Nebraska lawmakers get rid of "gun-free" zones in public places?"

Currently:  82% FOR reducing/eliminating gun free zones.

More votes would be even better.  :)

Now running 81%.  Still pretty good.

No-carry zones eliminated in "public" places like libraries, etc. would be great, but I also liked the idea of turning it into a simple trespassing violation if a CHP holder misses seeing a sign.

Why a violation?  Even better to point to sign and part ways....skip the violation.

I'm referring to the idea discussed here before (and I think it is the case in some other states) that accidentally (or intentionally) carrying on someone's posted property isn't a heinous "firearms offense" but a simple matter of trespassing.

This seems consistent with they way property rights are protected across the board.   If someone is hunting on my land without permission, I'm presumably going to get him for trespassing.

Iowa is like that, right?  Signs or declarations of a "gun-free zone" don't carry any legal weight, but if a property owner spots your gun, they can simply withdraw their permission for you to be on their property.  Once they make it known that they want you to leave, if you don't comply, you're trespassing.

The poll only has a few hundred votes right now.  I wouldn't worry too much about it.  Besides, I don't think the general public is really going to understand this bill; even the interviewees in the story seem not to comprehend that all of the current automatic gun-free zones will still be able to be gun-free if the bill becomes law.  They'll just have to post signs.

I just voted and it was 78/22.  Maybe anti-gun bigots are rallying their forces; we should do the same.  And I agree that the no guns sign should not have the power of law behind it, except that the bigot who posted the sign can tell the armed citizen to get off his property.

I don't know if Iowa is like that or not. A lot of folks here are way smarter than I am on stuff like that. I just show up here, keep up on the state legislative initiatives, and lobby my state rep accordingly.

All I know is that I have better luck lobbying my reps when I use logical tools and analogies to point out logical inconsistencies. Hypotheticals are a good way to peel away layers of the onion and get to the heart of the matter which is why I say let's not envision "Whole Foods" or an outlet mall for a moment when talking about posted property. Let's envision some landowner out in the panhandle who tells a friend "Sure you can camp and hike on my property, but I don't want you hunting or shooting there," and then he catches the guy hunting. Then he revokes the guy's access but the guy is caught hunting there again. At that point I think the legal remedy would/should be plain old trespassing.

Why would a grocery store or coffee shop be any different?
