Man arrested in break-in

An elderly Omaha man aimed his revolver low and to the left at an intruder just inside his front door early Wednesday, intending to thwart the home invasion suspect, but not kill him, police said.

"He didn't want to hit the guy," Omaha police Lt. John Sokolik said.

The suspect, who thought he was hit by the shot, was not injured and was arrested.

The shot was fired as an officer arrived outside, and the resident was briefly held at police gunpoint.

I'm glad the homeowners are OK.  The perp might not have been as fortunate at some other households.

What I don't get it is why the police did not throw the book at the intruder. The man breaks through the front door and OPD doesn't charge him with burglary?!!! Anybody ever heard of breaking and entering?!!! HELLO?!!

Instead they charge him with wimpy criminal trespass, criminal mischief, and disturbing the peace. Ridiculous!
