Missouri HP gave CHP names to the SSI

The Missouri State Highway Patrol has twice turned over the entire list of Missouri concealed weapon permit holders to federal authorities, most recently in January, Sen. Kurt Schaefer said Wednesday.

Questioning in the Senate Appropriations Committee revealed that on two occasions, in November 2011 and again in January,

Under Missouri law, the names of concealed weapon permit holders are confidential. The only place in Missouri where the names of all concealed carry permit holders is stored is among driver license records. Permit holders have a special mark on their licenses indicating they have been granted the privilege of carrying a gun.

The list was given to the Social Security Administration Office of Inspector General, Schaefer said he was told.

From what I've read on posts by members  of this forum Nebraska marks driver's licenses in the same way so that if you have a CHP and are pulled over the LEO knows beforehand that you may be carrying.

“Apparently from what I understand, they wanted to match up anyone who had a mental diagnosis or disability with also having a concealed carry license,” Schaefer said. “What I am told is there is no written request for that information.”

It is obvious they are looking for anyone with a CHP who might be mentally disturbed.  But, why give the info to the SSI?    It is the ATF which has the NICS and other weapons databases.   Is the ATF trying to sidestep 922 USC 18, which forbids the ATF from requiring FFL dealers to turn in form 4473s?

I don't believe so.  In that thread the question was if the ATF was scanning in 4473 forms.  It now seems that all the ATF had to do was make a phone call and they got the whole works.  Any "dupa" was the ATF calling twice and getting a fresh copy of the info. 

The question I had was why the ATF went through the SSI to get the info.  It seems to me that it is for no other reason than to evade the law prohibiting the ATF from accessing 4473 info unless they were doing a specific gun trace and then only for THAT gun.  The SSI has no requirements demanding Medicaid or Medicare recipients supply info concerning weapons they own or permits they have.  And, the SSI certainly does not have access to HIPPA information.  So, the question arises as to how, legally, NY officials and ATF agents know which CHP folks have "mental" problems (take SSRI drugs) without  violating a host of regulations protecting folks 4th Amendment rights?   

These troubling facts certainly support the contention that for all practical purposes the 4th and 5th Amendments are null and void if government agents can commit illegal acts with impunity.  The 1st Amendment is under constant attack by the PC crowd and its provisions concerning the right to freedom of expression of religion in public places is all but void, as well as the free press provisions, seeing how the major media has become nothing more than an extension of the Whitehouse press office.

I did bring this up with the NE AG's office when I got home because these statute in Nebraska precludes disclosure of this information. The response I got was that tying the CHP to the operator's license makes the info available to any LEO or other agency (like State when they update passport records) when they run your OL.

When I said that I understand that may be the logistics of how it is done, it is not what the statute says, I was politely told that the AG's office didn't care.

It gives cause to wonder if some Lib bureaucrat will (or has) give up NE info on the basis of a single phone call from a gov agent.

NE Drivers Licence birth dates are all marked in red not just CHP holders.
Checked my wife's Drivers License and her birth date is also in Red.

While searching through the NSP website regarding CHL processes, I find this little tidbit !!!!

Who keeps all of the information I am required to submit to obtain a permit and is it a public record?     

A listing of all applicants and permit holders along with pertinent information obtained in processing your application will be maintained by the Nebraska State Patrol. This information is confidential and is not a public record. It will be made available only to any federal, state, or local law enforcement agency upon request. The Nebraska State Patrol will electronically transmit information concerning permit status to the Department of Motor Vehicles to be contained on the driver's license abstract.

So, who is to say that some government 'wonk' in DC hasn't already made a call and asked for a list of all Nebraska CHL holders and added that list to a database
