Walmart Policy- background checks for ALL
« on: January 07, 2014, 04:44:42 PM »
I was just on vacation in Florida and was considering buying a shotgun to go trap shooting with friends. Called a few local shops, and nope, they don't sell to anyone from Nebraska because they're "not familiar with NE's ATF laws;" having a NE CCW (I do). So I figured I'd try Walmart, since they have shops in Nebraska, so they should be willing to sell long guns to a resident of that state.

I called into the local Walmart, and asked about purchasing a shot gun and leaving the same day with it, since I have a CCW that is also recognized by Florida. I was told that there was a 3-day wait and a background check. I asked again about having to wait for a background check even though I have a CCW, and was told that even with any CCW, there would be a background check and 3-day wait.

I looked at Walmart and Walmart Corporate's websites and could not find any policies regarding their sale of firearms, so I called Corporate to verify. The woman I talked with said that Walmart's policy is that EVERYONE pays $5 and has a background check run on them, regardless of whether they have a CCW or not. Has anyone with a CCW been able to buy the gun and walk right out, or is this a new policy put in place to keep track of who purchases a firearm (and essentially works the same as registration)?

I've bought one gun at Walmart, and I did not have to wait, other than waiting for the manager to walk me to the door.

My suspicion is you were experiencing a state of Florida law. That woman at corporate (per your quote) is full of beans.  I've purchased a number of guns from WM over the years.  Never had to pay a BG check fee, and took delivery that day.  Those states include TX, OK, MO and NE.  Grant it all long guns.

I bought a rifle at a local Walmart in Blair and they took information from my CCW. I filled out form 4473 on their computer and then was escorted to the door with my rifle.

They have a 3 day wait as far as I know for handguns but the long gun wait is a new one on me.  Might be new this year?

Walmart has handguns?  I haven't seen a handgun in a Walmart display for years.  Is this something new?

No idea.  I meant Florida has a 3 day wait on handguns in general as far as I know.

The law allowing the use of your CCW for the background check is a Nebraska law, so Florida would not follow it.  They may have there own pre checked system but I don't know about it.  The 3 day wait would also be a Florida issue, but I have never heard they have that for long guns....

A background check is on the person not on the firearm so it does not register any firearm to that person.

Federal law would require an out of state purchaser to have the FFL dealer to a NICS federal check.  There can be a delay status given.  If FL has a waiting period on all firearms that would be a state law, or just WalMart policy.
