Hopefully comming soon no CLEO Signoff

"I am pleased to report that all branches and offices within ATF have given the official okey dokey to eliminating the CLEO signature requirements for NFA Forms. This includes Counsel's office and the National Sheriffs' Association! The package has been sent on to the Department of Justice with recommendation for approval. The package will include:

1.Elimination of CLEO signature requirement.
2.Institution of CLEO "notification" similar to an FFL application. (A copy of the form will be sent to the CLEO as opposed to asking for permission.)
3.Trusts and LLC's and corps will still be available for use.
4.In the event of #3, a NICS check will be required when the weapon is physically transferred.
Unknown is whether the Citizenship Compliance form will be eliminated and merged into the various NFA forms instead of being a separate nuisance. ATF is leaning toward elimination."

The NFATCA has been working for several years to make this happen. I am proud to say that we have pushed this agenda item further with better results than we ever have before. ATF and its various branches have reviewed all of the potential issues and suggestions that we have presented. At this point, ATF has actually submitted the issue to the Department of Justice for final approval. We have never been able to get this issue out of ATF's "universe" before. At this point, it could be a matter of weeks or months before we receive final approval. I am hoping that the timing of the November release of several updated NFA forms is a good coincidence. That was the long answer. The short answer is yes, the process is in full swing.

Good news, I just wish this had happened before I set up a trust and sent in a form 1.

Wow that's good news.  I'm honestly surprised as I never thought NFA rules/laws would ever get any easier, I just always figured it would keep getting more and more difficult to obtain NFA weapons.  What are the chances of this becoming finalized?

Who knows if this can pass, but I know from meetings the ATF is not real happy about all the people using the trust system to avoid any background checks.

There is only one area of Nebraska that the CLEO is a problem and that works out if you know the secret handshake.

I know Lancaster is impossible unless you know the handshake, how does Sherriff Dunning (Douglas) feel about NFA guns?  I can't imagine Douglas county would be easy.

Tim Dunning signed for me with no problems. Dropped the form 4 off on a Friday, went back and picked it up Monday or Tuesday.

if i am understanding it right, i dont like #2.  the CLEO has no right to know what i have.  they shouldn't have to be notified about anything i do.

Trusts still have their advantages.  With your wife being on the trust too, she can take it to the range without the requirement of you being present.  Wait, given the territorialness of your wife with the CZs in the house, that might not be a good thing...   ::)

If they said, "You Can't have it.", you could just get a trust, and they'd not be the wiser..... Now, they'll know and there ain't anything you can do about that.  That is not a good thing...... what they don't know won't hurt YOU.

I live in a small town ...... if the Sherrif knows, then at least 1 person knows ...... and we all know "Two may keep a secret, if one is dead."  That is halfway to the whole town knowing, in short order.....

Well, if you're concerned about the CLEO knowing, the trust is still a viable option.

Won't they still send them a notification?
The Right to Keep and BEAR Arms is enshrined explicitly in both our State and Federal Constitutions, yet most of us are afraid to actually excercise that Right, for very good reason: there is a good chance of being arrested........ and  THAT is a damned shame.  III.

Douglas, Co and Sarpy, Co are a snap, Lincoln/Lancaster are the only CLEO problem areas I have dealt with, I have never done a transfer into Washington Co so can not comment.

Sheriff Dunning is a great guy and has no problem signing off on the forms. There are several other parts of the state where the sign off does not come easy. Hamilton county being one. If you live in Aurora the PD Chief will sign off but if you live in the county you are SOL on the sign off.

Maybe I've read the form 1 wrong, but I took it as any Chief LEO with jurisdiction in your area could sign it? What about the NSP Colonel? I know a brand new one is starting March 1st, but has anyone tried this angle? Or am I misunderstanding the ATF forms?
