There are two things everyone needs to understand about New Mexico law:
1st. DISPENSE in New Mexico means: The sale of alcoholic beverages for OFF or ON Premises consumption. (Not just on tap or bottle poured mixed drinks)
2nd. It is a 4th degree felony to carry a loaded or unloaded firearm into an establishment that DISPENSES alcohol.
Now that is out of the way we can discuss the EXCEPTIONS.
Places that sell for OFF premises Consumption
A person with a valid concealed carry permit may carry in an establishment that sells alcohol for OFF premises consumption if;
A. They have a valid carry permit ON THEIR person and,
B. the firearm is and remains concealed. (No open carry)
This includes places like Wal-Mart, 7-11 etc...
Places that sell for ON premises consumption
A person with a valid concealed carry permit may carry in an establishment that sells alcohol for ON premises consumption if;
A. The establishment has a New Mexico Beverage Control License that ONLY allows for the sale of beer and wine,
B. They have a valid carry permit ON THEIR person and,
C. the firearm is and remains concealed. (No open carry)
There are no provisions in New Mexico law for lawful carry (open or concealed) in any Beverage Controlled establishment that DISPENSES “Hard Liquor for ON premises consumption.
This would include places like Applebee’s, Chili’s etc…
