Military spouse- concealed carry permit- legal advice
« on: November 02, 2012, 05:07:37 PM »
The State Police lawyer just informed me that I can not apply for a CCW in NE as I am not a 'resident'.  I live here, my car has NE tags, I pay NE state income tax but our home of record is NM as we are not planning to stay in NE.  As per NE statue I would only be considered a resident if I pay taxes and have a NE DL and vote in NE.  I also found 2 earlier postings stating similar issues.  BTW my AD wife  would be allowed to apply for a CC permit! Who should I contact to, at least try, to change this unjust regulation?

First to get a permit quick this is what you need to do.  Next I have been working to get this changed in the statute.  Thought I had it this year but they backed down on making the proposed amendment.  Contact Senator Burke Harr he has a bill to get filed next session on this issue and we need to make certain he files it.

Your wife is a resident and can get a CCW and handgun purchase card. You are not, because you choose not to be one.  Game is in your court.

David, I have a NE purchase permit.  Also my wife is not a resident according to NE statues.  The point I tried to make is that we are treated differently under the law.

AAllen,
Thank you for your reply.  That was exactly the information I was looking for.
I will contact Senator Burke Harr.  If he hears the issue frequently enough he might move ;D

Why don't you just get a Nebraska DL and be done with it?  Nebraska isn't the only state that requires CHP holders to be residents.

Nebraska accepts 34 other state permits, among them States with great Out-of-State permit reciprocity such as Utah, Florida, Arizona, etc...  Applying for one of those out of state permits would be your easiest option.  Or you can always get a NM resident permit, which is also accepted in NE.

Correct, and it would not hurt to have a few friends or other military spouses give a call as well, once they know that there is several people concerned they move a little faster.
