Drunk guy hits another car and leaves, someone follows him while calling 911 to give dispatch a location of the hit and run driver. Witness' car gets rammed by the suspect so he opened fire. From what I've heard, the shooter hit the suspect 5 times in the upper chest and extremities. The shooter was also a CCW holder.

If he was be rammed by drunk driver, a vehicle being used in this manner is a lethal weapon.  I don't know if the witness felt like his life was threatened or if the drunk driver was doing it intentionally.

Personally I don't think a CHP holder should ever go looking for trouble. A good witness with a description of vehicle and license plates, leave the pursuit and shoot out for the police.
